Connecticut Lawyer Publishes Article on Federal Preemption by Dean Cordiano and René Ortega

Dean Cordiano and Rene Ortega wrote an article, "Federal Preemption in the Environmental Law Context," that was published in the January 2012 issue of Connecticut Lawyer. Using several recent court decisions as examples, Dean and Rene offer advice for environmental practitioners on when and how to raise a federal preemption claim. The article notes that "serious thought should be given to assert such claims given the potential for eliminating or narrowing damages, or eliminating injunctive relief to prevent interference with a facility's operations."
