The article offers best practices to comply with Maryland’s and New York’s statutory limitations on direct-to-consumer testing results. To ensure compliance, laboratories and marketers should ensure that a health care provider, as such a person is defined under Maryland or New York law, orders the appropriate test from a state-approved laboratory, and collects and sends the samples in accordance with the rules of each state.
