Dan Wenner authored an article, "How Accepting Responsibility Can Help At Sentencing," for Law360 on how defendants in some white collar criminal matters can help judges - and maybe themselves - by owning up to their responsibility at sentencing. Wenner provides an analysis of the recent sentencing decision by U.S. District Judge Robert Sweet of the Southern District of New York of a former hedge fund manager who pleaded guilty to securities fraud and making false statements to the SEC. Because of his effort to "do all a human being could do to take responsibility and to clean up the tragedy," Judge Sweet sentenced the defendant to probation instead of prison. "A defendant who knows when he's caught, and admits it instead of falsely denying it in the face of all evidence to the contrary," Wenner wrote, "will probably fare better at sentencing."
