Susan Huntington was quoted in an article, "Attys React To High Court's FCA Liability Ruling," in Law360. Huntington commented on the significance of the U.S. Supreme Court's ruling Thursday in Universal Health Services v. Escobar that corporations can face False Claims Act liability if they bill the government while out of compliance with regulations that aren't explicit conditions of payment. "The decision by the Supreme Court in Universal Health means that federal contractors, including any health-care provider participating in a federal health benefit program like Medicare or Medicaid, needs to pay attention to regulatory representations and warranties. These contract provisions cannot be dismissed as 'boilerplate.' Legal and compliance due diligence is critical to avoid the expanded risk of liability under the FCA created by the decision," said Huntington.
