Prosecution That Is Here and There Could Be Trouble for Accused Bomber

Publisher: The New Jersey Law Journal
September 21, 2016

Dan Wenner was quoted in an article, "Prosecution That Is Here and There Could Be Trouble for Accused Bomber," in The New Jersey Law Journal. In the article, Wenner notes that even though charges have been brought against Ahmad Khan Rahami in connection with bombings in Manhattan and New Jersey in three separate jurisdictions, the federal criminal cases from different judicial districts will likely be combined. "I would think, for judicial economy reasons, there's an interest in having the [federal] trials in one place. It creates kind of a mess, otherwise, and there's no good reason for it," said Wenner. "I would be shocked if this case proceeds in both districts." Wenner added that if the federal cases are tried sequentially, there could be inconsistent verdicts, which Rahami could use to his advantage.
