Appeals could drag Bridgegate case on for another year

Publisher: The Bergen Record
November 5, 2016

Dan Wenner was quoted in an article, "Appeals could drag Bridgegate case on for another year," in The Bergen Record. Defense attorneys for Bridget Anne Kelly and Bill Baroni immediately vowed to file appeals after their clients were found guilty in federal court in Newark on Friday of engineering lane closures in September 2013 to cause massive traffic jams in Fort Lee. For an appeal to succeed, defense attorneys must show not only that a ruling made against them was incorrect, but also that it would have changed the outcome of the trial. This kind of appeal is very hard to win, explained Wenner. "Judges get things wrong all the time," he said. "The question is not whether they got them wrong. The question is, if they had gotten it right the way the defense wanted it, would that have made a difference to the verdict?"
