Jillian B. Hirsch
Jillian Hirsch helps individual and corporate trustees, beneficiaries and heirs resolve matters involving trusts, wills and other estate-related concerns. Jillian has extensive experience handling trust and will contests, breach of fiduciary duty claims, contested accountings, actions involving reformation and termination of trusts, and guardianship and conservatorship proceedings. Jillian also has experience handling a wide range of complex commercial litigation matters, including those involving unfair and deceptive trade practices, securities, tortious interference, and complex product liability.

Represented wife in connection with appeal by husband of divorce judgment; obtained favorable ruling from Massachusetts Appeals Court that husband's interest in irrevocable spendthrift trust was properly included in marital estate for purposes of division upon divorce
Represented individual client in connection with appeal of divorce judgment that included husband's interest in a trust with an ascertainable standard in the marital estate for purposes of equitable division under M.G.L. c. 208, Section 34
Represented corporate trustee in Bosch litigation seeking declaratory judgment that trust adequately conveys decedent's intent to obtain optimal benefits of federal and state estate tax marital deductions
Represented legatee in connection with a breach of fiduciary duty claim against executor
Represented individual in connection with breach of fiduciary duty claim against custodian of gifts made under the Uniform Gifts to Minors Act
Represented non-profit in connection with its interests in a 501(c)(3) organization and issues concerning disqualified persons
Represented former school superintendent at jury trial in defense of various tort and civil rights claims; following seven days of trial in the United States District Court for the District of Massachusetts, obtained favorable settlement for client.
Successfully represented finance company at jury trial against claim by major insurance company for rescission of insurance policy; following bench trial, obtained favorable verdict against insurance company for unfair and deceptive trade practices and obtained damage award in excess of $3 million, including multiple damages and attorneys' fees; successfully argued appeal before the U.S. Court of Appeals for the First Circuit

Represented division of major entertainment company at jury trial against engineering firm alleged to have negligently caused damage in connection with the renovation of landmark theater in Boston; following five days of trial, obtained favorable settlement for client
