John "Jay" Nolan has tried most types of commercial cases to juries and courts in state and federal courts around the country since joining the firm in 1969. In addition to securing verdicts or judgments in almost 100 cases, he has argued appeals in the Connecticut Supreme and Appellate Courts and the First and Second Circuits. He has extensive experience in cases involving disputes between owners of businesses. Jay has also represented institutional clients who have been victimized in sophisticated frauds perpetrated by debtors, investors and advisors.
In addition to Jay's extensive commercial litigation experience, he started the firms insolvency practice in the early 1970s. He has represented institutional creditors, committees, and debtors over the last 35 years. Most recently, he has represented electric utilities in the bankruptcies that followed the deregulation of that industry.
He has had extensive training and experience in all types of ADR. He is available for engagement as an arbitrator and mediator in commercial disputes.
According to the 2013 edition of Chambers USA, "John Nolan offers clients more than 40 years of litigation and ADR [experience], having tried over 100 commercial cases in various state and federal courts throughout the USA. Nolan is also sought for his insolvency [experience], having set up the firm's insolvency practice."
Represented a REMIC trustee in a seven-week jury trial which ended in December, 2012 resulting in a verdict holding the individual owner of a corporate general partner to be its alter ego and liable on an eight-figure judgment against the partnership and general partner. The corporate general partner had executed a guaranty of the partnership's mortgage debt that had recourse to it only in the event of fraud. The jury also awarded punitive damages which, under Connecticut law, are the legal fees and expenses of the plaintiff.
